Do handwritten wills need witnesses in BC?

The ordinary requirements under the Wills, Estates and Succession Act include a written will, the will-maker’s signature and two witnesses. There is no general unwitnessed holograph route equivalent to Ontario’s. A court may cure some deficient records under section 58, but a future court application is not a signing plan.

Family provision matters

Section 60 permits a spouse or child to seek variation where a will does not make adequate provision. An Islamic distribution clause does not remove that possibility. Get advice about how the law may affect your intended shares.

Questions to settle before drafting

List the people who depend on you, the assets you own and any previous commitments. If you have a blended family, property outside Canada or a business interest, write those issues down before meeting an adviser. Ask how beneficiary designations and joint ownership fit into the plan rather than treating the will as a complete inventory of every transfer.

Use the right format and check the whole document

Select a witnessed format appropriate for your province and follow its signing instructions. Review the executor, alternate appointments, family list and bequests together. If you already have an unwitnessed handwritten document, ask a BC lawyer to review it while you can still clarify your intentions. Do not rely on a possible court remedy after death.
