Is a holograph will valid in Ontario?

Ontario’s Succession Law Reform Act recognizes a will wholly in the testator’s own handwriting and signed by that person, without witnesses. This is a formal requirement, not a guarantee that every handwritten note is an effective estate plan.

What if I use a printed will?

The ordinary witnessed route requires the testator’s signature or acknowledgment before two witnesses present together, followed by their signatures in the testator’s presence. A downloaded PDF is a draft until the required signing process is completed.

Prepare your family information first

Write down the full names and relationships of your spouse, children, parents and other relevant relatives. Record any separation, previous marriage, adoption or support arrangement for review. Do not select a different relationship in a calculator simply to make a desired percentage appear. Keep a separate list of people or charities you want to consider for a discretionary bequest.

Connect the will to your actual property

Prepare an inventory showing what you own, what you owe and which records need checking. Include the location of insurance and registered-account beneficiary forms, jointly held property records and any existing estate documents. Ask a legal professional which assets are governed by the will and whether your proposed plan raises family or support issues.

Review, sign and make the original findable

Check names, executor choices, alternate appointments and every distribution clause before signing. Keep the completed original secure and tell your executor where it is. Save funeral wishes and urgent contact information somewhere your family can access promptly. Revisit the plan when your family, assets or province changes.
